Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (AML/CFT)
From 1 July 2018, we will be legally required to obtain more information from you. This is due to the Anti-Money Laundering and Countering Financing of Terrorism Act 2009 (AML/CFT). This Act came into being as a direct result of preventing money laundering or the financing of any terrorism. Through obtaining more information from you, we will have more knowledge about the transactions we do on your behalf. We are also able to ensure that we are not in breach of our requirements under the Act. If for whatever reasons, we have any suspicions we have a legal obligation to report this. Please keep in mind that when we meet with you to discuss new legal matters we may need what is called customer due diligence (CDD) from you. This is similar to what we already do when you are buying a house, but we may need more documentation from you.
Information Required
We will be required to have the below information from you before we can carry out any work for you. If you are unable to provide this, then we will be unable to act for you.
- Person
Proof of your identity and date of birth – like a drivers licence, birth certificate or passport.
Proof of your address – like a recent utilities bill or bank statement.
- Company or Trust
Same as above but we will also need further information about other people involved in the company or Trust like the details of people who are Directors, Shareholders, Trustees or Beneficiaries.
Extra Information Required
We may also need to ask you questions about the source of the money, and your reason for the proposed work you are asking us to do.
Keep in mind that we are not required to hold onto the originals of these documents. Rather we will just need a photocopy and keep it in our records for future use.
